Macy's appeals Martha merch ruling

New York - Macy's Inc. is appealing ruling on Friday that would allow JCPenney to carry home merchandise designed by the Martha Stewart team so long as it isn't branded with Stewart's name.
There is reportedly some $100 million worth of Stewart-designed merchandise awaiting release to JCP stores under the label JCP Everyday - an echo of the Martha Stewart Everyday home brand that was once a Kmart exclusive.
According to Reuters news service, in filing its appeal yesterday, Macy's said the judge "erred in several significant respects."
