Done: Martha/Macy's settle suit

New York - The lawsuit Macy's filed against Martha Stewart Living Omnimedia to prevent the Stewart brand from appearing on bedding, bath and cookware at JCPenney has been settled, both parties announced this morning. But that doesn't end all the litigation surrounding the fraught Penney/Stewart partnership.
In a statement issued this morning, Macy's Inc. noted its claim against rival Penney "remains subject to the court's decision."
Macy's filed suit against Penney in August 2012, claiming its deal with MSLO interfered with Macy's exclusive contract for Stewart-branded products.
Terms of the Macy's/MSLO settlement were not disclosed in today's announcement. Both Macy's and MSLO said the agreement will not impact their financials materially.
Some kind of settlement had been expected. Last October, Penney and MSLO renegotiated their contract - essentially throwing in the towel on former JCP ceo Ron Johnson's plan to anchor the home floor with a full complement of soft and hard home goods carrying Stewart's imprimatur.
