Judge rules in Macy’s/JCPenney dispute over Martha Stewart contract

New York – The Macy’s/JCPenney lawsuit turns out to have been forgotten but not gone, as a wag once said. Until yesterday.

According to several published reports, New York State Supreme Court Justice Jeffrey Oing ruled yesterday that JCPenney had indeed interfered with the 2006 contract between Macy’s and Martha Stewart Living Omnimedia when it struck its own deal for Stewart-branded merchandise in 2011.

The judge reportedly instructed both retailers to begin negotiating on damages and attorney’s fees.

JCPenney has the option of appealing the decision. However, since ceo Mike Ullman returned to the helm in spring 2013, he has moved consistently to put the Martha imbroglio behind him.
